When the property gets sold, from escrow, they'll split the check according to your ownership interest if you guys both agree to go to forward with the sale. The default assumption, not taking into account contributions and offsets of your respective contributions to the property, would be that you both own 50% and you're both entitled to 50% of the net proceeds from the sale. If he's going to propose some sort of alternate split based on him paying a mortgage down that you weren't paying on, then he's going to have to propose that to you and you guys are both going to have to agree and give the escrow company instructions. Otherwise you can't move forward with the sale if you guys aren't on the same page and you would need to do something like a court supervised partition process. If he's just saying because he was on the loan and you're not, you're not entitled your portion of the equity, that's just wrong. If he's saying that he paid the mortgage all this time and you didn't pay the mortgage as long as he can establish that he's entitled to an offset in my opinion and he should get a credit for what he's paid that you didn't pay into and then settle up that way. I'm an attorney, but I'm not your attorney. Also, I'm not a California attorney, but I would imagine this is generally the way it goes in California as well, usually practice in Arizona.
